Cloudflare, Inc. is on a mission to help build a better Internet. In furtherance of Internet research, we have made it possible for Internet users to access and use the Interplanetary File System ("IPFS") infrastructure and the Ethereum blockchain through our gateway to the decentralized internet ("Distributed Web Gateway") without the need of downloading software. We have also made it possible to make content from the IPFS infrastructure and the Ethereum blockchain available via custom human readable domain names utilizing HTTPS. In addition, we provide a DNS over HTTPS resolver and a proxy to the distributed web to resolve certain decentralized domain names ("Distributed Web Resolver").
These Terms of Use govern all access and use of our Distributed Web Gateway and Resolver (collectively, "Services"). By accessing or using our Services, you agree to be bound by these Terms of Use. PLEASE READ THESE TERMS OF USE CAREFULLY, AS THEY CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND CLOUDFLARE. If you do not agree to these Terms of Use, you are not authorized to access or use our Services. While accessing or using our Services you are required to comply with all applicable statutes, orders, regulations, rules, and other laws.
You may not use the Services for any reason if you are subject to sanctions or otherwise designated on any list of prohibited or restricted parties, including but not limited to the lists maintained by the U.S. Government (e.g., the Specially Designated National List and Foreign Sanctions Evaders List of the U.S. Department of Treasury, and the Entity List of the U.S. Department of Commerce), the European Union or its Member States, or other applicable government authority. You may not use the Services to export or re-export any information or technology to any country, individual, or entity to which such export or re-export is restricted or prohibited.
We reserve the right, at our sole discretion, to modify or replace the Terms of Use at any time. Any such changes will take effect immediately when posted on our website. You are responsible for reviewing and being familiar with these modifications. The use of the Services after any modification to the terms constitutes your acceptance of the Terms of Use as modified. We may, in our sole discretion and without liability to you, with or without prior notice and at any time, modify or discontinue, temporarily or permanently, any portion of our Services.
THE SERVICES ARE MADE AVAILABLE TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH THE EXPRESS UNDERSTANDING THAT THE SERVICES ARE MADE AVAILABLE FOR THE PURPOSE OF INTERNET RESEARCH AND THE CLOUDFLARE ENTITIES (AS DEFINED IN CLOUDFLARE SELF-SERVE SUBSCRIPTION AGREEMENT) HAVE NO OBLIGATION TO MONITOR, CONTROL, OR VET DECENTRALIZED DOMAIN NAMES, CONTENT STORED IN IPFS, ETHEREUM, OR DECENTRALIZED NAME REGISTRIES, OR DNS DOMAIN NAMES THAT USE THE SERVICES. AS SUCH, YOUR USE OF THE SERVICES IS AT YOUR OWN DISCRETION AND RISK. THE CLOUDFLARE ENTITIES MAKE NO CLAIMS OR PROMISES ABOUT THE QUALITY, ACCURACY, RELIABILITY, SAFETY, OR SECURITY OF THE SERVICES OR THE CONTENT YOU ACQUIRE THROUGH THE SERVICES. ACCORDINGLY, THE CLOUDFLARE ENTITIES ARE NOT LIABLE TO YOU FOR ANY LOSS OR DAMAGE THAT MIGHT ARISE, FOR EXAMPLE, FROM THE SERVICE'S INOPERABILITY, UNAVAILABILITY, OR SECURITY VULNERABILITIES OR ANY CONTENT YOU ACQUIRE OR FAIL TO ACQUIRE THROUGH THE SERVICES.
THE CLOUDFLARE ENTITIES EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME JURISDICTIONS MAY PROHIBIT A DISCLAIMER OF WARRANTIES AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION.
You expressly acknowledge and agree that Ethereum applications can be written maliciously or negligently, Cloudflare has no liability for your interaction with such applications, and such applications may cause loss of property or identity. These warnings and others provided by Cloudflare in no way evidence or represent an on-going duty to alert you to the potential risks of utilizing the Services.
YOU ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE SERVICES. IN NO EVENT WILL THE CLOUDFLARE ENTITIES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICES OR CONTENT ACQUIRED THROUGH THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE OR ANY OTHER LEGAL THEORY, WHETHER OR NOT THE CLOUDFLARE ENTITIES HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
YOU AGREE THAT THE AGGREGATE LIABILITY OF THE CLOUDFLARE ENTITIES TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF RELATING TO THE USE OF OR ANY INABILITY TO USE THE SERVICES OR CONTENT AVAILABLE THROUGH THE SERVICES OR OTHERWISE UNDER THIS AGREEMENT, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO THE AMOUNTS YOU HAVE PAID TO CLOUDFLARE TO ACCESS AND USE THE SERVICES IN THE 12 MONTHS PRIOR TO THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. ACCORDINGLY, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
Cloudflare may resolve certain decentralized domain names as part of the Distributed Web Resolver service. Cloudflare provides the Services for the purpose of Internet research, and does not endorse, sponsor, or make any commitment to any decentralized name registry. Cloudflare resolves certain decentralized domain names at its own discretion, without any guarantee that the Distributed Web Resolver will behave in a manner as expected by you or any particular decentralized name registry. Cloudflare may discontinue the Distributed Web Resolver or any portion or feature thereof, either entirely or only with respect to certain decentralized name registries in its sole discretion with or without notice and at any time without liability or other obligation to you.
Your access or use of our Services is governed by our Privacy Policy. Without limiting the foregoing, we wanted to highlight that when you access our Services, we record your IP address but only retain such information for a limited period of time in accordance with our Privacy Policy.
Cloudflare is not a website hosting provider, and we cannot remove material from the Internet that is accessible through the Services. In addition, Cloudflare has no control over any decentralized name registries. If you believe that material or decentralized domain names accessible through the Services violates your copyright or is illegal, you are encouraged to notify the developers of the IPFS, Ethereum, or decentralized name registries as applicable, directly. You can also report abuse using our reporting form available here. In appropriate circumstances, we may disable access through our Services to the specific content or proxied decentralized domain names set forth in your abuse report.
